Welcome to Medzy! Thank you for visiting the Medzy Website, Application and Services.  Our mission is to make it easy for you to get access to the medications you need by building the modern pharmacy infrastructure and technology. We hope that you will enjoy and appreciate using our Services.

 

Medzy Inc. (“Medzy”) (the company that owns and operates the Services) takes your privacy and security of Personal Information very seriously. We have provided and will continue to provide a secure environment and this strict Privacy Policy (the “Policy”) describes the limited ways your information is collected, used and the limited access to such information. To help you navigate this Policy, please refer to the following definitions for clarification:


Application” refers to the free app for iOS or Android created and owned by Medzy, which allows you to access the Services from your Device.

 

Device” refers to the handheld or tablet device through which you may be accessing and using the Services through the Application. Note that a computer is not a Device. You can access the Services from a computer through the Website.

Current Pharmacy” refers to the pharmacy with control of your pharmacy file at the time that you sign up for an account with Medzy [and that will transfer your file to a Participating Pharmacy so that you can take advantage of the Services].

Participating Pharmacy” refers to one of our partner pharmacies that you will be paired with to receive home delivery of your medications.

"Personal information" refers to any information that relates to a natural person and allows that person to be identified, i.e., that directly or indirectly reveals something about the identity, characteristics (e.g., abilities, preferences, psychological tendencies, predispositions, mental abilities, character and behaviour of the person concerned) or activities of that person, regardless of the nature of the medium or the form in which the information is accessible (written, graphic, sound, visual, computerized or other).

Services” includes visiting or using our Website and Application in order to be partnered with a Participating Pharmacy and to order and purchase medications from a Participating Pharmacy for home delivery.

User” refers to a member of the public who creates an account using the Website or the Application to make use of the Services and to order and purchase medications from a Participating Pharmacy. In this Policy, a User may be referred to as “you” or “your”.

Website” is the website located at www.medzy.ca, which is owned and operated by Medzy and includes all subdomains, present and future.

Summary

Medzy is subjected to the Personal Information Protection and Electronic Documents Act (PIPEDA), which governs how we may use and disclose your Personal Information. We collect and process Personal Information from our customers for the purpose of providing the Services. This includes, but is not limited to, the name, email address, medication history, medical conditions and health insurance information of the user. The Personal Information we collect is used for specific purposes such as processing orders, medical consultation, communication, legal compliance and improving services. We retain Personal Information for the duration necessary to fulfill the purposes outlined in this Policy and to comply with legal obligations. Customers have the right to access, correct, or delete their Personal Information and withdraw consent for processing, except where such processing is necessary for legal compliance.

About Us and Definitions

 

The Services are owned and operated by Medzy Inc., a corporation located in Montreal, Canada at the address listed below. Where this Policy refers to “Medzy” it may refer to Medzy and / or its affiliates, and its respective shareholders, officers, directors, employees, agents, partners, principals, representatives, successors and assigns (collectively “Representatives”), depending on the context. Any reference to “we”, “our”, or “us” in this Policy shall also refer to Medzy and / or its Representatives. In this Policy, a User or any other Website or Application visitor may be referred to as “you” or “your”.  

 

Additional definitions shall be made throughout this Policy, but they will be recognizable as they will be capitalized, bolded, and in quotation marks. Additional definitions may also be found in the Terms of Use and will have the same meaning in this Policy as they do there. The definitions found in this Policy shall also apply to the ​Terms of Use​.

By visiting or using the Website in any way, by downloading the Application or by registering for an account, you agree to be bound by the terms of the Policy. By submitting Personal Information to us on the Website, the Application or via other means, you consent to Medzy’s collection, use and disclosure of such Personal Information in accordance with this Policy (as amended from time to time) and as permitted or required by law. Please note that i​​f you do not consent to this Policy, or if you later choose to withdraw your consent, we will not be able to provide you the Services and you must not access or use the Application.  

 

Medzy reserves the right, at any time and without prior notice, to modify or replace, in whole or in part, the Policy. Any changes to the Policy can be found at this URL. It is your responsibility to check the Policy periodically for changes. You can always find the date of the most recent version of the Policy at the top of this page. Your use of the Services following the posting of any changes to the Policy constitutes acceptance of those changes. If there are any significant changes to the Policy that materially affect the way we treat your information, we will use commercially reasonable efforts to notify you by sending a notice to your email address if you have created an account on the Website or Application or by posting a prominent notice on the Website and Application.

What Does This Privacy Policy Cover? 

 

This Policy covers the treatment of personally identifiable information, i.e., any information that identifies an individual, or can be used in conjunction with other information to identify an individual (“Personal Information”) and other information gathered by Medzy when you are accessing the Services. This Policy also covers Medzy’s treatment of any Personal Information that Medzy may share with its business partners or other third parties under very limited circumstances.  

 

This Policy does not apply to the general practices and treatment of information (whether Personal or not) by third parties that Medzy does not own or control, including, but not limited to, any third-party websites or services that you elect to access through the Services or via a link from the Services that are not owned by Medzy, including the third-party websites or services of any Current Pharmacy or Participating Pharmacy (“Third-Party Websites”), or to individuals that Medzy does not manage or employ. While we attempt to facilitate access or link only to those Third-Party Websites that share our respect for your privacy, we cannot take responsibility for the content or privacy policies of those Third-Party Websites. We encourage you to carefully review the privacy policies of any Third-Party Website that you access.  

 

Finally, this Policy does not cover any Personal Information you send to Medzy via any non-secured, non-encrypted mode of communication, such as email, instant messenger or other messaging service, or Facebook, Instagram or any other social media, as communications via these methods may be subject to interception, loss, or alteration. While we welcome your comments and suggestions sent to us in this manner, we encourage you to carefully examine what Personal Information you send to Medzy via these methods. 

 

No Collection of Personal Information as a Matter of Course 

 

Medzy does not gather any of your Personal Information while you access the Services, unless required by law, or unless you are asked to provide such information and voluntarily choose to do so. Personal Information is only gathered with your informed consent. By using the Services, you are providing your consent to the collection, use, processing, transfer, disclosure and retention of your Personal Information as set out in this Policy. Where you have provided Personal Information, it will only be used for the stated purpose, as detailed more specifically in the next sections of this Policy.

Personal Information Collected and Its Uses 

 

The following is a list of Personal Information collected from you when you access the Services and what we use it for. You acknowledge and agree that you are submitting this Personal Information with your informed consent.  

 

  • Account Information.” You must enter your first name, last name, phone number, email address, password and date of birth to create a Services account. We use this Account Information to facilitate your signing into the Services so that you can more easily receive your medications.  

 

If you are legally authorized to make healthcare decisions for an individual (a child or a parent for example), you may create a profile for them by providing their first and last name, date of birth, phone number, contact information, health information and insurance information. We use the date of birth and your assertion of their relationship with you to confirm your eligibility to obtain the Services for that individual and their eligibility to receive the Services.

If you wish to add an adult “Registered Dependent” to your family account without legally being the substitute decision-maker (e.g. if you want to add a spouse to the family account), we will need their first name, last name and phone number, so we can directly contact them and obtain their explicit consent to be added to the Account. No other Personal Information will be collected until we receive their explicit consent.

  • Identification Information.” Given the nature of the Services that we provide, we might need to collect information to validate your identity, such as your driver's license number, a photo of your driver’s license or other relevant identification information.

  • Health Information.” Given the nature of the Services that we provide, we need to collect certain health information from you to share with your Participating Pharmacy. The health information that we need to collect from you includes your medications, prescriptions from your doctor and your birth date. You also have the option to provide us with the name of your Current Pharmacy (or Pharmacies), your Current Pharmacy records, your allergies, your health problems or special health conditions. 

 

  • Insurance Information.” We collect your insurance information which includes your first name, last name, date of birth and sex, health insurance number, your insurance provider(s) public and private (if applicable, Member ID number, group number, certificate number) and a photo of your health insurance card in order to validate your identity and communicate with your insurance provider(s) to file claims on your behalf and to ensure that the payment you make for your medications has been reduced according to your specific insurance coverage.  

 

  • Contact Information.” If you would like to communicate with us by email, by phone or by text, you will be required to share your first name, last name, email address and phone number so that we are able to respond to you. We will also use your contact information to send you proactive refill reminders for your medications and to respond to you if you contact Medzy with an emergency question. 

 

  • Shipping Information.” We need your home or other physical address (or multiple addresses, as applicable) to deliver the medications that you have ordered and purchased.  

 

  • Payment Information.” In order to process payments for your medications, we will require your payment information. We accept payment via credit card, Visa debit card, PayPal, Apple Pay, or Google Pay. If you are paying via credit card or Visa debit card, we will collect information relating to transactions and payment, such as the method of payment used, the date and time, the billing address and other related information. Otherwise, the Website or Application can connect with your PayPal, Google Pay or Apple Pay accounts, as applicable, to provide payment for your medications.  

 

  • Purchase Information.” In order to complete orders, sales/transactions we will require specific information such as the name and quantity of the medication you wish to order, your preferred products and a delivery address.  

 

  • Products or Services Information.” To provide you with the Services, we will collect information such as your appointment(s) date(s) and other information about the Services we have provided to you. These could include, but are not limited to, medication information for a price request, requests for pharmaceutical advice, requests to obtain a prescription.  

 

  • Customer Satisfaction Information.” If you choose to provide or share with Medzy information such as comments, questions, requests and complaints regarding our Services and Websites (for example, when you fill out a form, complete surveys or contact one of our employees or representatives, as well as your preferences and interests); we will collect this information to improve our products and Services.  

 

 

In addition to the functions and uses just described, Medzy may also use your Personal Information you have submitted in for legitimate business reasons, including:

  • To perform general User support;  

  • To investigate and manage complaints;  

  • To understand your preferences, needs and to improve the Services experience;  

  • To display and provide relevant and personalized content and advertisements through various channels based on information collected about you;  

  • To operate, administer, maintain, monitor, develop, improve and provide all the features of our Website, including consult appointments; 

  • To improve our Services and develop new Services and Website features; 

  • To bill provincial health plans or health insurance plans; 

  • To facilitate payment with respect to purchases on our Platform; 

  • To send you messages, updates, security alerts and account notifications for marketing purposes, if you have previously consented to the processing of your Personal information for such purposes; 

  • To perform research and analysis relating to our business and Services; 

  • To detect and prevent fraud, error, spam, abuse, security incidents and other harmful activities; 

  • Perform any functions as otherwise explicitly described to you at the time of your submission of Personal Information; and 

  • For any other purpose required by law.

Use of De-Identified Data 

 

Medzy may de-identify and/or aggregate your personal information, including information in your medical records, in such a way that it cannot be used alone or in combination with other information to identify you. We may use this information for research purposes, or to learn about how we can improve the quality of our Services. The research may include artificial intelligence algorithms to assist professionals for faster decision making but will never replace the licenced professionals. Areas of a.i. assisted algorithms include: medical document classifying, medical document parsing, patient risk prioritisation, shipment prioritisation, helpdesk ticket classifying. We will not use Data to re-identify Users or for any other purpose prohibited by Applicable Law. We will only de-identify Information in a manner that complies with Applicable Law. We are committed to making insights gained from this critically useful Data available without compromising our commitment to respect the privacy of our customers. 

 

 

Children under the age of 14  

 

Our Website is not intended for children under 14 years of age. If you are under 14 years of age, you must not provide us with your Personal information without the consent of your parent or guardian. If we learn that we have collected or received personal information from a child under the age of 14 without verification of parental consent, we will delete that information. If you are a parent or guardian and become aware that your child has provided us with Personal information without your consent, please contact our Privacy Officer to request that we delete that child's Personal information from our systems. 

 

In addition, only a parent or legal guardian of a child under the age of 14 may access or amend the child's Personal information. For this purpose, we may request any relevant documentation from the parent or legal guardian, such as a copy of any custody and access agreement or related court order, to process any access or amendment request. 

 

Security of Information 

 

Medzy uses only industry best practices (physical, electronic and procedural) in keeping any data collected (including Personal Information) secure. In addition, Medzy uses third-party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to operate the Services, and these third parties have been selected for their standards of security, both electronic and physical.  

 

All information, including Personal Information, is transferred with encryption using Secure Sockets Layer (“SSL”) or Transport Layer Security (“TLS”), the most common security standards for internet data transfer and transactions. You can use your browser to check Medzy’s valid SSL security certificate.  

 

Medzy uses Paysafe and Global Payments for the processing of secured credit card and Visa debit card payments for User payments made through the Services. Both Paysafe and Global Payments are certified as a PCI-DSS (Payment Card Industry Data Security Standard) Service Provider Level 1, the highest-volume level for credit card transaction companies.

What We Use It For (the “Purpose” of Processing) : Allow you to use your PayPal, Apple Pay or Google Pay accounts to pay for your medications 

To the extent that analytics identifiers are generated from third parties, these may be considered personal data collected from third parties, and you can find details about that further below in this Policy.

Non-Disclosure of Personal Information to Third Parties 

 

Except as provided in the next paragraph and specified in the next three sections of this Policy, Medzy does not divulge any Personal Information gathered via the Services to third parties. We do not allow access to the personal health information of any of its users to any third party without getting the users’ express consent, except where required by law or regulatory requirements. Moreover, Medzy does not sell, rent, trade or license any Personal Information regarding Users or other Website or Application visitors to third parties. Only the Representatives and subcontractors of Medzy are responsible for the management and development of the Services, and only these individuals have access to the information collected there. These Representatives and subcontractors have all been instructed to comply with the Policy and are under contractual obligations of non-disclosure. Any third parties to whom we disclose personal information - when we have the user’s consent to do so - are bound by confidentiality obligations and are prohibited from using or disclosing your personal information for any purpose other than as needed to perform their services on our behalf, to comply with legal requirements or for additional purposes where your express consent is provided. 

 

Notwithstanding anything in the Policy to the contrary, we may share any information we have collected about you or that you have submitted (whether Personal Information or not): (1) in response to subpoenas, court orders, or legal processes, or to establish, protect, or exercise our legal rights or defend against legal claims or demands; (2) if we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, fraud, or situations involving potential threats to the safety of any person, or any violation of the Terms of Use; (3) if we believe it is necessary to investigate, prevent, or take action regarding situations that involve abuse of the Services infrastructure or the internet in general (such as voluminous spamming, denial of service attacks, or attempts to compromise the security of the Services infrastructure or the Services generally); (4) to a parent company, subsidiaries, joint ventures, or other companies under common control with Medzy (in which case we will require such entities to honour this Policy); (5) if Medzy merges with another entity, is subject to a corporate reorganization, or sells or transfers all or part of its business, assets or shares (in which case we will require such entity to assume our obligations under this Policy, or inform you that you are covered by a new privacy policy).

For the provision of the Services, we may disclose some of your Personal Information with certain third parties in order to facilitate the functioning of the Services and the coordination of communication and transactions between Users and their Participating Pharmacy. These third parties are identified below, along with what they do with the Personal Information transferred to them.

Who We Transfer It To : Companies that provide data analytics for the Services, specifically Google Analytics, Google Firebase, Segment, Heap, Crazy Egg and Facebook Pixel 

What They Do With It : Provide us with analytics as to how the Services are used, as further detailed in the Limited Gathering of Information section below 

​​​Cross-Border Transfer of Personal Information 

 

When you use the Services, your Personal Information may be transferred to and/or stored in another country where we or our service providers operate, including the United States. By using the Services, you agree to such cross-border transfer of your Personal Information and understand that your information may be available to government authorities under lawful orders and laws applicable in foreign jurisdictions. At the time of the latest update of this policy, the services affected by cross-border transfers are our helpdesk, newsletter and scheduling services (Zendesk, Customer.io and Calendly). Medzy will protect Personal Information disclosed to third parties by contractual agreements requiring that those third parties adhere to confidentiality and security procedures and protections.  

 

Email Communications and Compliance with Anti-Spam Laws 

 

Medzy uses Customer.io to manage our mailing list and to send out our newsletter, promotional and account related emails, Zendesk for customer service purposes and to respond to User queries, SendGrid in order to validate Users’ emails and Calendly to schedule appointments between you and us or between you and a Participating Pharmacy and to send you emails about such appointments (Customer.io, Zendesk, SendGrid and Calendly, collectively, the “Email Service Providers”). Personal Information is transferred to the Email Service Providers in order for the emails to be sent out properly. The email address in your Account Information is only used to send out emails; the Email Service Providers do not use this Personal Information for any other purpose and will not transfer or sell your Personal Information to any other third party. For more information, please refer to Customer.io's Privacy Policy, Zendesk's Privacy Policy, Twilio's Privacy Policy, which applies to SendGrid and Calendly's Privacy Policy.   

 

You may unsubscribe from Medzy’s mailing list at any time, by following the link at the bottom of the Medzy emails. Other types of emails, such as relational (emails related to your account) and emails related to your medications will not have an opt-out option as they are necessary for the use of the Services and fulfilling your orders. 

 

Medzy’s practices with regard to its emails are designed to be compliant with anti-spam laws, specifically the law unofficially called “CASL”, or Canada’s Anti-Spam Law (S.C. 2010, c. 23). If you believe you have received email in violation of these laws, please contact us using the contact information further up in this Policy. 

 

Limited Gathering of Information for Statistical, Analytical and Security Purposes 

 

Medzy automatically collects certain information using third-party analytics programs to help us understand how Users use the Services, but none of this information can identify you personally. Specifically, we use the following analytics programs: Google Analytics, Google Firebase, Segment, Heap, Crazy Egg and Facebook Pixel. As an example of how these third-party analytics programs are used, each time you visit the Website or the Application, we automatically collect (as applicable) your IP address, browser and computer or Device type, access times, the web page from which you came, the web page(s) or content you access, and other related information. We use information collected in this manner only to better understand your needs and the needs of Users in the aggregate. Medzy also makes use of information gathered from third-party analytics programs for statistical purposes to keep track of the number of visits to the Website and the Application, the specific pages on the Website and the number of Users, with a view to introducing improvements to the Website and the Application.  

 

Your IP address and other relevant information we collect using third-party analytics programs may be used in order to trace any fraudulent or criminal activity, or any activity in violation of the Terms of Use

  

Aggregated Information 

 

In addition to the information collected by the analytics programs as described in the previous section, we may also generate, use and disclose aggregated and / or anonymized information and statistics about Users for marketing and strategic purposes.   • Location services (foreground and background) – The Application will require access to location services (user permission only). You have the ability to turn off location services at any time using the Application.  

  • External storage –The Application may access the Device’s external storage to store system files needed for the Application to work effectively.  

  • Notifications - The Application may send you notifications (user permission only).] 

  • Wi-Fi Connection Information - The Application may retrieve network connectivity and speed information from your Device.

Please note that the Application has restricted access to your Device, including: 

 

  • Restricted access to accounts – The Application does not give information about other applications installed on your Device. 

  • Restricted access to unique device identification – The Application does not give information about your Device’s hardware components, which could be used to track the user on different web services. 

  • Restricted access to the phone subscriber identity (SIM) - The Application does not give information about the mobile phone services and provider, which could be used to track the user on different messaging and phone services. 

  • Restricted access to phone number – This Application does not give information on the user’s phone number to any Third Parties without the prior consent of the user.  

 
Uninstall of the Application 

 

You may uninstall the Application; uninstall methods may vary depending on your Device or iOS or Android version. Medzy has no control over the uninstall function and denies any responsibility for your use thereof, and any data or personal data sent to third parties as a result of such activity.  

 

Medzy Advertising and Opting Out  

 

Medzy uses certain advertising networks to provide advertising to you. Specifically, we use Google Ads and Display Network and Facebook Pixel. By using the Website, you consent to their use. Specifically, Medzy uses the remarketing features of Google Ads’ interest-based advertising, which displays Medzy advertisements that should be of particular interest to you based on your browsing and activity history interacting with the Website. These advertisements will appear on third-party websites around the web. Google uses specific cookies to allow them to serve these advertisements to you. Additionally, Medzy also uses Facebook Pixel to serve you advertisements for Medzy when you are on Facebook. You may prevent this type of advertising by deleting the appropriate Google or Facebook cookie through your browser, though this may not be permanent. For a more permanent solution, you may opt out of such Google and Facebook advertising by adjusting your Google or Facebook ad settings or by using the WebChoices online opt-out tool.  

 

Accessibility, Correction and Deletion of Personal Information 

 

You have the right to: (i) verify what Personal Information Medzy holds about you; (ii) ask for your Personal Information to be corrected or updated; and (iii) withdraw your consent to the use by Medzy of your Personal Information and have it deleted from our records. If you wish to inquire about and verify and / or correct Personal Information Medzy holds about you, or if you wish to have all your Personal Information permanently deleted from our records, please contact us using the contact information further up in this Policy. The Privacy Officer will respond in writing to your request for access or rectification within 30 days from the date the request is received. The access to your Personal Information, except where prohibited by law from doing so, or where permitted by law to restrict your access and have legitimate reasons for doing so, may take the form of a report in which you will find the history of the services that have been provided to you as well as the information collected during the use of your account. 

 

Please note that deletion of your Personal Information may make it impossible for you to use the Services, or certain portions thereof, and Medzy and its Representatives accept no responsibility for any damages, pecuniary or otherwise, resulting therefrom. If you request deletion of your Personal Information, Medzy reserves the right to retain some of your Personal Information for a reasonable time in order to satisfy our legal obligations, requirements imposed by the Ordre des Pharmaciens du Québec or for the purpose of a legal procedure of any sort.

Despite Medzy’s best efforts to ensure that third parties will not access or obtain your Personal Information through your use of the Services, complete confidentiality and security cannot currently be guaranteed on the Internet or where data is transferred via digital wireless technology of any type. Communication via the Internet or wireless data transmission is subject to interception, loss, or alteration. You acknowledge and agree that Medzy and its Representatives ​​cannot be held responsible for damages resulting from the transmission of confidential information or Personal Information in this manner and that such communications are at your own risk.
