Thank you for visiting Medzy's Website, App, and services. Our mission is to make it easy for you to access the medications you need by building modern pharmaceutical infrastructure and technology. We hope you enjoy using our Services.

Medzy Inc. ("Medzy") (the company that owns and operates the Services) takes your privacy and the security of your Personal Information very seriously. We have provided and will continue to provide a secure environment. This Privacy Policy (the "Policy") describes how we collect, use, disclose, and protect the Personal Information of our clients, prospects, and users of the Website and App. To help you navigate this Policy, please refer to the following definitions:

"App" refers to the free iOS or Android application created and owned by Medzy, which allows you to access the Services from your Device.

"Device" refers to the mobile phone or tablet through which you can access and use the Services via the App. Note that a computer is not a mobile device. You may access the Services from a computer via the Website.

"Current Pharmacy" refers to the pharmacy that holds your pharmacy file at the time you register for a Medzy account, and which will transfer your file to a Participating Pharmacy so you can benefit from the Services.

"Participating Pharmacy" refers to one of our partner pharmacies with which you will be matched to receive home delivery of your medications.

"Personal Information" refers to any information that relates to a natural person and allows them to be identified, either directly or indirectly — meaning it reveals something about a person's identity, characteristics (e.g., skills, preferences, psychological tendencies, predispositions, mental capacity, character, and behaviour), or activities, regardless of the medium or form in which it is accessible (written, graphic, audio, visual, digital, or otherwise).

"Services" include visiting or using our Website and App in order to be matched with a Participating Pharmacy and to order and purchase medications from a Participating Pharmacy for home delivery.

"User" refers to a member of the public who creates an account using the Website or App to use the Services and order and purchase medications from a Participating Pharmacy. In this Policy, a User may also be referred to as "you" or "your."

"Website" refers to the website located at www.medzy.ca, owned and operated by Medzy, and includes all current and future subdomains.

Summary

Medzy is subject to the Personal Information Protection and Electronic Documents Act (PIPEDA), which governs how we may use and disclose your personal information. We collect and process the Personal Information of our clients for the purpose of providing the Services. This includes, but is not limited to, your name, email address, medication history, medical conditions, and health insurance information. The Personal Information we collect is used for specific purposes such as processing orders, medical consultation, communication, legal compliance, and service improvement. We retain personal information for as long as necessary to fulfill the purposes described in this Policy and to comply with certain legal obligations. Clients have the right to access, correct, or delete their Personal Information and to withdraw their consent to the processing of such information, unless such processing is required for compliance purposes.

Please read this Policy carefully to understand our practices regarding the collection, processing, and storage of your information.

About Us and Definitions

The Services are owned and operated by Medzy Inc., a company located in Montreal, Canada, at the address set out below. Where this Policy refers to "Medzy," it may refer to Medzy and/or its affiliated companies, as well as its shareholders, directors, officers, employees, agents, associates, principals, representatives, successors, and assigns (collectively, the "Representatives"), depending on the context. Any reference to "we," "our," or "us" in this Policy will also refer to Medzy and/or its Representatives. In this Policy, a user or any other visitor to the Website or App may be referred to as "you" or "your."

Additional definitions will be provided throughout this Policy, but they will be recognizable as they will appear in uppercase letters, bold, and quotation marks. Additional definitions may also be found in the Terms of Use and will have the same meaning in this Policy. The definitions in this Policy also apply to the Terms of Use.

Acceptance and Amendments

By visiting or using the Website in any way, downloading the App, or registering for an account, you agree to be bound by the terms of this Policy. By submitting Personal Information to us through the Website, App, or by other means, you consent to the collection, use, and disclosure of your Personal Information by Medzy in accordance with this Policy (as amended from time to time) and as required by law. Please note that if you do not consent to this Policy, or if you choose to withdraw your consent later, we may no longer be able to offer the Services and you will therefore be required to stop using the App.

Medzy reserves the right to modify or replace this Policy, in whole or in part, at any time and without notice. All changes to the Policy can be found at this URL. It is your responsibility to review the Policy periodically for changes. You can always find the date of the most recent version of the Policy at the top of this page. Your continued use of the Services following the posting of any changes to the Policy constitutes acceptance of those changes. If there are significant changes to the Policy that materially affect how we handle your information, we will make reasonable efforts to notify you by sending an email to your registered address or by posting a prominent notice on the Website and App.

This Policy should be read together with the Terms of Use, as both documents govern your use of the Services.

We respect your right to privacy and are committed to protecting your personal information. You have the right to exercise your rights and preferences regarding your personal information freely and without fear of reprisal from us. Please know that your trust is of utmost importance to us.

What Does This Privacy Policy Cover?

This Policy covers the processing of personally identifiable information — that is, any information that can be used to identify a person, or that can be used in conjunction with other information to identify a person ("Personal Information") — and other information collected by Medzy when you access the Services. This Policy also covers Medzy's processing of any Personal Information that Medzy may share with its business partners or other third parties in very limited circumstances.

 

This Policy does not apply to the general practices and information processing (personal or otherwise) of third parties that Medzy does not own or control, including third-party websites or services that you may choose to access through the Services or through a link from the Services that are not owned by Medzy, websites or services of your Current Pharmacy or Participating Pharmacy ("Third-Party Websites"), or persons that Medzy does not manage or employ. While we make efforts to facilitate access to and create links only to third-party websites that respect your privacy, we cannot assume responsibility for the content or privacy policies of any third-party website you access.

Finally, this Policy does not cover Personal Information you send to Medzy through any unsecured, unencrypted means of communication, such as email, instant messaging, or any other messaging service, or through Facebook, Instagram, or any other social media, as communications through these channels may be subject to interception, loss, or alteration. While we welcome comments and suggestions sent to us in this manner, we encourage you to carefully consider the Personal Information you send to Medzy through these communication channels.

No Systematic Collection of Personal Information

Medzy does not collect any of your Personal Information when you access the Services unless the law permits or requires it, or unless you are asked to provide it and voluntarily choose to do so. Personal Information is only collected with your informed consent. By using the Services, you consent to the collection, use, processing, transfer, disclosure, and retention of your Personal Information as described in this Policy. The Personal Information you provide will only be used for the purposes stated, as set out in the following sections of this Policy.

Personal Information Collected and How We Use It

The following is a list of the Personal Information collected from you when you access the Services and the purposes for which we use it. You acknowledge and agree that you are submitting this Personal Information with your informed consent.

Account Information. You must provide your first name, last name, phone number, email address, password, and date of birth to create a Services account. We use this Account Information to facilitate your access to the Services so you can more easily receive your medications.

If you are legally authorized to make healthcare decisions for another person (a child or parent, for example), you may create a profile for them by providing their first and last name, date of birth, phone number, contact information (for adults), health information, and insurance information. We use the date of birth and the nature of your relationship with that person to confirm your eligibility to obtain the Services on their behalf and their eligibility to receive the Services.

 

If you wish to add an adult to your family account without having legal authority over that person (for example, if you wish to add a spouse to your family account), we will need their first name, last name, and phone number so we can contact them and obtain their explicit consent to be added to the account. No other Personal Information will be collected until explicit consent has been received.

 

Identification Information. Given the nature of the Services we provide, we may need to collect information to verify your identity, such as your driver's licence number, a photo of your driver's licence, or other relevant identification information.

Health Information. Given the nature of the Services we provide, we must collect certain health information from you to share with your Participating Pharmacy. The health information we must collect from you includes your medications, your doctor's prescriptions, and your date of birth. You also have the option of providing the name of your Current Pharmacy (or pharmacies), the contents of your current pharmacy file, your allergies, your health conditions, or your special health concerns.

 

Insurance Information. We collect your insurance information, including your first name, last name, date of birth, sex at birth, health insurance number, your public and private insurance provider(s) (if applicable), member identification number, group number, certificate number, and a photo of your insurance card, in order to verify your identity and communicate with your insurance provider(s) to file claims on your behalf and ensure that payments for your medications are reduced based on your specific insurance coverage.

Contact Information. If you wish to communicate with us by email, phone, or text, you will need to share your first name, last name, email address, and phone number so we can respond to you. We will also use your contact information to send you proactive refill reminders for your medications and to respond to you if you contact Medzy with an urgent matter.

Shipping Information. We need your home address or another mailing address (or multiple addresses, as applicable) to deliver the medications you have ordered and purchased.

Payment Information. In order to process payments for your medications, we will need your payment information. We accept payments by credit card, Visa debit card, PayPal, Apple Pay, or Google Pay. If you pay by credit card or Visa debit card, we will collect information related to the transaction and payment, such as the payment method used, the date and time, the billing address, and other related information. Otherwise, the Website or App may connect to your PayPal, Google Pay, or Apple Pay accounts, as applicable, to process payment for your medications.

Purchase Information. In order to complete orders, sales, and transactions, we will need specific information such as the name and quantity of medication you wish to order, your preferred products, and a delivery address.

Product or Service Information. To provide the Services, we will collect information such as your appointment dates and other information about the Services we have provided to you. This may include, but is not limited to, information about medications for a price quote, requests for pharmaceutical advice, and requests to obtain a prescription.

Customer Satisfaction Information. If you choose to provide or share with Medzy information such as comments, questions, requests, and complaints about our Services and Websites (for example, when you fill out a form, complete surveys, or contact one of our employees or representatives, as well as your preferences and interests), we will collect this information to improve our products and Services.

In addition to the functions and uses described above, Medzy may also use the Personal Information you have submitted for legitimate business purposes, including to:

  • Provide general user support

  • Investigate and manage complaints

  • Understand your preferences and needs and improve the Services experience

  • Display and provide relevant and personalized content and advertisements through various channels based on information collected about you

  • Operate, administer, maintain, monitor, develop, improve, and provide all features of our Website, including managing appointments

  • Improve our Services and develop new Services and Website features

  • Bill provincial health insurance plans or other health insurance plans

  • Facilitate payment for purchases on our platform

  • Send you messages, updates, security alerts, and account notifications for marketing purposes, if you have already consented to the processing of your Personal Information for these purposes

  • Conduct research and analyses related to our activities and services

  • Detect and prevent fraud, errors, spam, abuse, security incidents, and other harmful activities

  • Perform any other functions explicitly described to you at the time of submitting Personal Information

  • For any other purpose permitted or required by law

Use of De-Identified Data

Medzy may de-identify and/or aggregate your Personal Information, including information contained in your medical files, so that it cannot be used alone or in combination with other information to identify you. We may use this information for research purposes or to learn how we can improve the quality of our Services. Research and development activities may include artificial intelligence (AI) algorithms to guide healthcare professionals in making more effective decisions, but these algorithms will never replace professionals in their practice. Applications of AI may include: classification of medical documents, reading medical documents followed by data extraction, risk-based prioritization of orders, prioritization of shipments, and classification of support requests.

 

We will not use data to re-identify users or for any purpose prohibited by applicable law. The de-identification of Personal Information will only be carried out in a manner consistent with applicable law. We are committed to making the information derived from this data extremely useful without compromising our commitment to respecting our clients' privacy.

Children Under 14
Children Under 14

Our Website is not intended for children under the age of 14. We do not knowingly collect Personal Information from children under 14. If you are under 14, you must not provide your Personal Information without the consent of your parent or guardian. If we learn that we have received Personal Information from a child under 14 without verification of parental consent, we will delete that information. If you are a parent or guardian and you are aware that your child has provided us with Personal Information without your consent, please contact our privacy officer so we can remove that child's Personal Information from our systems.

 

Furthermore, only the parent or legal guardian of a child under 14 may access or modify the child's Personal Information. To that end, we may request any relevant documentation from the parent or legal guardian, such as a copy of any custody and access agreement or court order, in order to process any access or modification request.

Information Security

Medzy uses only industry best practices (physical, electronic, and procedural) to ensure the security of the data collected (including Personal Information). In addition, Medzy works with third-party vendors and hosting partners to provide the hardware, software, networking, storage, and related technology necessary to operate the Services, and these third parties have been selected for their security standards, both electronic and physical.

 

All information, including Personal Information, is transferred using encryption via Secure Sockets Layer ("SSL") or Transport Layer Security ("TLS"), the most widely used security standards for data transfer and transactions on the Internet. You can use your browser to verify Medzy's valid SSL security certificate.

 

Medzy uses Paysafe and Global Payments for secure credit card and Visa debit card payment processing for user transactions through the Services. Paysafe and Global Payments are certified as Level 1 PCI-DSS (Payment Card Industry Data Security Standard) service providers, the highest level for credit card companies by volume.

Information Collected from Third Parties and How We Use It

We sometimes obtain Personal Information about you from third parties. The following explains the details of this Personal Information — what it is, where it comes from, and how it is used. Your informed consent is the legal basis on which we rely to hold and process this Personal Information.

 

Account Information. Types of Personal Information processed: Certain Google or Facebook account information; Certain third-party service provider account information Who provides this information: Google or Facebook; Third-party service providers in the healthcare industry (with explicit consent required) Purpose of collection: To allow you to use your Google or Facebook account to log into the Website or App so we can provide you with the Services; To speed up account creation, the onboarding process, and service delivery

Health Information. Types of Personal Information processed: Your pharmacy file from your Current Pharmacy; prescriptions from your doctor Who provides this information: Your Current Pharmacy; your doctor Purpose of collection: To provide the Services; to carry out a file or prescription transfer to a Participating Pharmacy for the purpose of preparing your prescriptions and sending you your medications

Insurance Information. Payment Information. To the extent that analytics identifiers are generated by third parties, these may be considered Personal Information collected from third parties. You will find further details on this later in this Policy.

Non-Disclosure of Personal Information to Third Parties

Except as described in the following paragraph and specified in the next three sections of this Policy, Medzy does not disclose to third parties the Personal Information collected through the Services. We do not allow third parties access to Personal Information (medical or otherwise) of our users without the explicit consent of the user, unless the law or regulatory requirements demand it. Furthermore, Medzy does not sell, rent, exchange, or license to third parties any Personal Information about users or other visitors to the Website or App. Only Medzy's Representatives and subcontractors are responsible for managing and developing the Services, and only these individuals have access to the information collected. These Representatives and subcontractors have all been instructed to comply with their contractual non-disclosure obligations. All third parties to whom we disclose Personal Information — where we have the user's consent to do so — are bound by confidentiality obligations and are prohibited from using or disclosing your Personal Information for any purpose other than to provide their services on our behalf, to comply with legal requirements, or for additional purposes where your express consent has been provided.

Notwithstanding any other provision in this Policy, we may share any information we have collected about you or that you have submitted (whether Personal Information or not): (1) in response to subpoenas, court orders, or other judicial proceedings, or to establish, protect, or exercise our legal rights or to defend against legal claims or demands; (2) if we believe it is necessary to investigate, prevent, or take action regarding illegal activities, fraud, or situations involving potential threats to the safety of any person, or any violation of the Terms of Use; (3) if we believe it is necessary to investigate, prevent, or take action regarding situations involving abuse of the Services infrastructure or the Internet in general (such as mass spamming, denial of service attacks, or attempts to compromise the security of the Services infrastructure or the Services in general); (4) to a parent company, subsidiaries, co-enterprises, or other companies under common control with Medzy (in which case we will require such entities to comply with this Policy); (5) if Medzy merges with another entity, is subject to a corporate reorganization, or sells all or part of its activities, assets, or actions (in which case we will require the acquiring entity to assume our obligations under this Policy, or inform you that you are covered by a new privacy policy).

We may disclose certain of your Personal Information to third parties to facilitate the operation of the Services and to coordinate communications and transactions between Users and their Participating Pharmacy. These third parties are identified below, along with their use of the Personal Information transferred to them.

Health Insurance Account Information. To whom we transfer it: Participating Pharmacy; Third-party service providers in the healthcare industry (with explicit consent required) Purpose of collection by third parties: To provide you with your medications and generally provide pharmaceutical services, including communicating with you about your medications and pharmaceutical services

Insurance Information. To whom we transfer it: Insurance provider(s); Participating Pharmacy Purpose of collection by third parties: To ensure your insurance coverage is applied when purchasing medications and other products; to adjust the order price based on your insurance coverage

 

Contact Information. To whom we transfer it: Companies that provide messaging and scheduling services, in particular Customer.io, Zendesk, Calendly, and SendGrid; Participating Pharmacy Purpose of collection by third parties: To send you emails (as detailed in the Email Communications section below) and, in the case of Calendly, to schedule appointments between you and Medzy or between you and a Participating Pharmacy; to communicate with you to provide pharmaceutical services, your medications, and information about your medications

Shipping Information. To whom we transfer it: Shipping partners such as Intelcom, Vaistat, Canada Post, Purolator, Tecor Purpose of collection by third parties: To ship your medications

Payment Information. To whom we transfer it: Payment processors, in particular Paysafe and Global Payments Purpose of collection by third parties: To process your payments for medication purchases

Advertising Identifiers. To whom we transfer it: Companies that provide online advertising networks, in particular Google and Facebook Purpose of collection by third parties: To send you advertisements about Medzy when you browse the Internet (as detailed in the Medzy Advertising section below)

 

Analytics Identifiers (including IP addresses). To whom we transfer it: Companies that provide data analytics for the Services, in particular Google Analytics, Google Firebase, Segment, Heap, Crazy Egg, and Facebook Pixel Purpose of collection by third parties: To provide us with analytics on how the Services are used (as detailed in the Limited Collection of Information section below)

Cross-Border Transfer of Personal Information

When you use the Services, your Personal Information may be transferred to and/or stored in another country where we or our service providers operate, including the United States. By using the Services, you consent to such cross-border transfer of your Personal Information and understand that your information may be made available to governmental authorities pursuant to legal orders and applicable laws in foreign jurisdictions. As of the last update of this Policy, the main services involved in cross-border transfers are: our customer service system, our newsletter service, and our scheduling service (Zendesk, Customer.io, and Calendly). Medzy will protect the Personal Information disclosed to third parties through contractual arrangements requiring these third parties to comply with privacy and security procedures and protections.

Email Communications and Anti-Spam Compliance

Medzy uses Customer.io to manage our mailing list and send our newsletter, promotional emails, and account-related emails; Zendesk for customer service purposes and to respond to user inquiries; SendGrid to validate user emails; and Calendly to schedule appointments between you and Medzy or between you and a Participating Pharmacy, and to send you emails about these appointments (Customer.io, Zendesk, SendGrid, and Calendly are collectively referred to as the "Email Service Providers"). Personal Information is transferred to these email service providers so that emails can be sent correctly. The email address in your account information is only used to send emails; the email service providers will not use this Personal Information for any other purpose and will not transfer or sell your Personal Information to third parties. For more information, please refer to Customer.io's privacy policy, Zendesk's privacy policy, Twilio's privacy policy (which applies to SendGrid), and Calendly's privacy policy.

 

You may unsubscribe from Medzy's mailing list at any time by following the unsubscribe link at the bottom of Medzy emails. Other types of emails, such as relational emails (account-related emails) and medication-related emails, will not have an unsubscribe option as they are necessary for the use of the Services and the fulfillment of your orders.

 

Medzy's email practices are designed to comply with anti-spam laws, in particular the law officially known as "CASL," or the Canadian Anti-Spam Legislation (S.C. 2010, c. 23). If you believe you have received emails in violation of these laws, please contact us using the contact information provided above in this Policy.

Limited Collection of Information for Statistical, Analytics, and Security Purposes

Medzy automatically collects certain information using third-party analytics programs to help us understand how Users use the Services, but none of this information can personally identify you. More specifically, we use the following analytics programs: Google Analytics, Google Firebase, Segment, Heap, Crazy Egg, and Facebook Pixel. As an example of how these third-party analytics programs are used, each time you visit the Website or App, we automatically collect (where applicable) your IP address, your browser and type of computer or device, access times, the web page from which you came, the web page or pages you visit or the content you access, and other related information. We use the information collected in this way solely to better understand your needs and the needs of users as a whole. Medzy also uses information collected from third-party analytics programs for statistical purposes to track the number of visits to the Website and App, specific pages on the Website, and the number of users, in order to make improvements to the Website and App.

 

Your IP address and other relevant information we collect using third-party analytics programs may be used to trace any fraudulent or criminal activity, or any activity in violation of the Terms of Use.

Aggregated Information

In addition to information collected by analytics programs as described in the previous section, we may also generate, use, and disclose aggregated and/or anonymized information and statistics about users for marketing and strategic purposes. However, no individual user will be personally identifiable from this aggregated and/or anonymized information and statistics.

Tracking Technology ("Cookies") and Related Technologies

Medzy uses tracking technology ("cookies") and related technology, such as tags, pixels, and web beacons, on the Website. By visiting or using the Website, you consent to their use. Cookies are small text files placed on your computer or device when you visit a website, in order to track site usage and improve the user experience by storing certain data on your computer or device.

More specifically, we use cookies for the following purposes:

  • To enable your login to the Website

  • To facilitate the proper functioning of the Services

  • To conduct internal and general user analyses on the Services and carry out research to improve the Services content using the analytics programs listed above in this Policy

  • To facilitate online advertising, as described in more detail below in this Policy

  • To help identify potentially fraudulent activity

Your browser can be configured to refuse cookies or delete them after they are stored. Please refer to your browser's help section for instructions. Please note that deleting cookies may reduce your user experience on the Website by requiring you to re-enter certain information, including information required to use the Website. In addition, deleting cookies may limit certain features. Medzy and its Representatives will not be responsible for any features that may not function following the deletion of cookies, or for any loss or damage (financial or otherwise) resulting from features that do not work or that have reduced functionality.

Access Restriction

Please note that the App has restricted access to your device and the following information:

  • Restricted access to accounts — The App does not provide information about other applications installed on your Device.

  • Restricted access to the Device's unique identifier — The App does not provide information about the hardware components of your Device, which could be used to track users across different websites.

Uninstalling the App

You may uninstall the App; uninstall methods may vary depending on your device or iOS or Android version. Medzy has no control over the uninstall function and accepts no responsibility for your use of it or for any data or Personal Information sent to third parties as a result of such activity.

Medzy Advertising and Opt-Out

Medzy uses certain advertising networks to deliver advertising to you. More specifically, we use Google Ads and Display Network and Facebook Pixel. By using the Website, you consent to their use. More specifically, Medzy uses Google Ads remarketing features, which display Medzy ads that may interest you based on your browsing and activity history on the Website. These ads are served on third-party websites. Google uses specific cookies to offer you these ads. Medzy also uses the Facebook pixel to offer you Medzy ads when you are on Facebook. You can prevent this type of advertising by deleting the appropriate Google or Facebook cookie in your browser, though this may not be permanent. You have the right to: (i) verify what information Medzy holds about you; (ii) request that your Personal Information be corrected or updated by Medzy and removed from our files; and (iii) withdraw your consent to Medzy's use of your Personal Information and have it deleted from our files. If you wish to learn more about the Personal Information Medzy holds about you, verify and/or correct it, or if you wish to have all your Personal Information permanently deleted from our files, please contact us using the contact information provided above in this Policy. The Privacy Officer will respond in writing to your access or correction request within 30 days of receiving it. Access to your Personal Information, unless the law prohibits it or the law permits us to restrict your access and you have legitimate reasons to do so, may take the form of a report containing the history of services provided to you and the information collected during your use of your account.

 

Please note that deleting your Personal Information may prevent you from using the Services, or certain parts thereof, and that Medzy and its Representatives accept no responsibility for any damages, financial or otherwise, that may result. If you request the deletion of your Personal Information, Medzy reserves the right to retain certain information for a reasonable period in order to fulfill its legal obligations, requirements imposed by the Ordre des pharmaciens du Québec, or for the purposes of any judicial proceeding of any nature.

Risks associated with the Internet and wireless data transmission

Despite all efforts made by Medzy to ensure that third parties do not access or obtain your Personal Information, it is currently impossible to guarantee complete confidentiality and total security on the Internet or when data is transferred through any type of wireless digital technology. Internet communications or wireless data transmissions may be intercepted, lost, or altered. You acknowledge and agree that Medzy and its Representatives cannot be held liable for damages resulting from the transmission of confidential information or Personal Information in this manner, and that such communications are made at your own risk.
